CHAPTER- V
RULES OF CONDUCT
5.1 Application and definition.
These rules shall apply to all officers of Pakistan Steel
whether probationer, regular, contract or any other category on duty or on
leaves within or outside Pakistan. Deputationists from Federal or Provincial
Government shall be governed by the conduct rules of the respective Government.
5.2 Disciplinary rules.
Violation of the provisions in the succeeding paras of this
chapter shall constitute misconduct and render the officer liable for
disciplinary action under the disciplinary rules of Pakistan Steel.
5.3 Gifts.
No officer shall accept in any manner from any source a
gift, present or reward, the receipt of which may place him under any
obligation, which may influence or affect the discharge of his official duties.
5.4 Acceptance of awards.
No officer shall, except with prior permission of the Board,
accept an award, title or decoration.
5.5 Demonstration in favour of an officer.
No officer shall cause a demonstration to be held in his
favour to project his image or show strength to obtain any undue advantage.
5.6 Lending and borrowing.
No officer shall lend money to or borrow money from or place
himself under any financial obligation to any person with whom he has any official
dealings.
5.7 Declaration of assets.
Officers shall declare their assets as per proforma
prescribed by the Corporation from time to time.
5.8 Trade, employment or work.
No officer shall engage himself in any trade, business, or
undertake any employment or work with any organization or obtain insurance
agencies in his own name or on behalf of his wife.
5.9 Living beyond means.
No officer shall live beyond his means or indulge in
ostentation on occasions of marriage or other ceremonies.
5.10 Unauthorized communication of official information.
No officer shall pass on directly or indirectly an official
secret document or information pertaining to Pakistan Steel to any other person
or body not authorized to receive it.
5.11 Use of political influence.
No officer shall bring or attempt to bring political
influence directly or indirectly by approaching member of the Senate, National
Assembly or Provincial Assembly in support of any claims arising in connection
with his employment.
5.12 Management of Newspapers or Periodicals.
No officer shall participate in the editing or management of
any newspaper or other periodicals etc, except official publications of
Pakistan Steel.
5.13 Radio broadcasts or television programme and communications
to the press.
No officer, except with the previous sanction of the
competent authority or in the bonafide discharge of his duties, shall
participate in a radio broadcast or television programme or contribute any
article or write any letter either anonymously or in his own name to any
newspaper or periodical.
5.14 Publication of information and public
speeches capable of embarrassing Pakistan Steel or Government.
No officer, shall in any document published, or in any
communication made to the press, in his own name, or in any public speech or
television programme or in any radio broadcast delivered by him, make any
statement or opinion which is capable of embarrassing Pakistan Steel or the
Government.
5.15 Evidence before committee.
No officer shall give evidence before a public committee
except with the previous sanction of the competent authority. Officer giving
such evidence shall, however, not criticize the policy or decisions of the
Management of Pakistan Steel or the Government. This rule shall not apply to
evidence given before Statutory Committee nor to evidence given in judicial
inquiries.
5.16 Taking part in political activities/
elections.
No officer shall form or join or take part or subscribe in
aid of, or assist in any way, directly or indirectly any political activity or
political party in and outside the country. Nor he shall take part in Elections
to the Local Bodies, Provincial/ National Assembly or Senate.
5.17 The provision of this para shall not apply to officers required, or
permitted by or under any law, or order of the Government for the time being in
force, to be candidates at such elections.
5.18 If any question arises whether any movement or activity falls within
the scope of this rule, the decision of the Chairman thereon shall be final.
5.19 Participation in agitation / strikes
considered as “MISCONDUCT” and “SUBVERSION”
Officers are prohibited from taking part in agitation /
strikes/ union activity or subscribing in aid of or assisting in any way
political movement in Pakistan or relating to the affairs of Pakistan. Officers
are thus debarred from joining any political party. Similarly if an officer
disobeys a lawful order or abandons works without reasonable excuse or depart
from any area specified in an order of a competent authority, he shall be
proceeded against on the charge of “MISCONDUCT”. An officer shall also be proceeded against,
if he is found to be engaged in subversive activities independently or in
association with others, under these rules. For subversive activities penalty
can be compulsory retirement, removal or dismissal from service.
5.20 Propagation of sectarian creeds.
No officer shall propagate any sectarian feeling or take
part in such activities or create feeling of discontent or frustration amongst
other employees.
5.21 Nepotism, favouritism and victimization.
No officer shall indulge in provincialism, parochialism,
nepotism, favouritism, victimization and willful abuse of his office. In case
of indulgence in such practices, the officer concerned shall be liable to
disciplinary action under these rules.
5.22 Acceptance of foreign trips sponsored by commercial firms.
No officer of Pakistan Steel shall undertake any foreign
trip at the invitation of the parties having commercial dealings with Pakistan
Steel except with the prior permission of the Government.
5.23 Employment with contractors / suppliers.
Ex-Employees of Pakistan Steel who seek employment with
contractors / suppliers having dealing with Pakistan Steel are not allowed to
enter Pakistan Steel as their representative at least for a period of two years
from the date they leave Pakistan Steel.
5.24 Studies.
No officer shall undertake studies in an Educational
Institution except with the permission of the P.E. / Director / Chairman. No
such permission shall be granted unless the competent authority is satisfied
that the prosecution of studies shall not interfere with the officer’s official
duties. Permission granted may be withdrawn if the competent authority is
convinced that the officer is taking part in politics or prosecution of such
studies is interfering with the satisfactory performance of the duties. In case
of those who want to prosecute studies in spare time without attending any
educational institutions, no permission is necessary.
5.25 Marriage with foreign National.
No officer shall be allowed to marry a foreign (except those
of India) unless prior written permission from the competent authority is
obtained. In case he or she marries a foreign national without permission, in
Pakistan or on tour or on leave Ex-Pakistan, he/she will be committing
“Misconduct” and would be liable to termination of his service forthwith, without assigning any
reason, and salary in lieu of notice period. In that case the amount of bond
money and expenses, if any will be recovered from him.
5.26 Handing over of residential accommodation.
No officer shall hand over possession of residential
accommodation allotted to him by Pakistan Steel to any person other than a
person duly authorized by a letter issued by competent authority.
5.27 Reporting to the Board of Directors.
If any officer, not below the level of Director (PSMC-I),
feels that an act or decision of the Chairman and Chief Executive is unlawful
or detrimental to the interests of the Corporation, and on which point he has
submitted his observation / opinion /views to the Chairman / Chief Executive,
and despite such opinion or view a decision has been made, then he shall have the
right to represent his view / opinion to the Board of Directors to apprise it
of the facts of cases and reasons of his disagreement and indicating losses or
damages that may ensue as a result of that particular act or decision of the
Chairman / Chief Executive. Should the concerned Director fail to do so it will
be assumed that the concurs with the action of the Chairman and CEO.
A Director
may make reference to the Board only in respect of areas of his responsibility.
The Board hoped that this empowerment would be used by the
in house Directors with responsibility and due regard to discipline.
5.28 Protection against Harassment of
Women at the Work Place Act, 2010.
“All the employees including Management grade Officers /
Chief Executive Officer of Pakistan Steel are to adopt code of conduct as per
Act, 2010 titled “Protection Against Harassment of Women at the Work Place Act,
2010” in order to ensure professional and dignified work environment so as to
provide protection and safety to the women of Pakistan Steel which would be
free of Harassment and intimidation in order to curb any complaint of sex
harassment at Work Place. All the
complaints if arisen will be dealt / processed as per guideline provided in the
said Act – 2010”.
